1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the website and services of ChirpnBirdies, LLC (“we,” “our,” or “us”), including www.chirpnbirdiesdiscgolf.com and any related tools or applications (collectively, the “Service”). By creating an account, registering for an event, or using the Service, you agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 13 years old to use the Service. Users under 18 must have parental or guardian consent to register for events. By using the Service, you represent that you meet all eligibility requirements.

3. Account Registration

• You must provide accurate and current information when creating your account.
• You are responsible for maintaining the confidentiality of your password and account credentials.
• Notify us immediately at [email protected] if you suspect unauthorized access or account misuse.
• You are responsible for all activity occurring under your account.

4. Event Registration

When registering for an event through ChirpnBirdies, you enter into an agreement directly with the Event Host or Organizer. The Event Host sets event rules, divisions, eligibility criteria, and refund policies. You agree to comply with all host-specific terms and event requirements.

5. Payments & Processing

Payments are securely processed through Stripe. ChirpnBirdies does not store or have access to your full card information. By submitting payment details, you authorize Stripe to process payments in accordance with its Privacy Policy.

Refunds: All refunds are the sole responsibility of the Event Host. ChirpnBirdies does not manage, issue, or guarantee refunds on behalf of event organizers. If you have a refund request, you must contact the Event Host directly.

6. Organizer Responsibilities

• Event Hosts are responsible for the accuracy of event listings, registration fees, and refund handling.
• Hosts must comply with all applicable laws, safety regulations, and venue requirements.
• Hosts using our email tools must comply with anti-spam laws (including CAN-SPAM, CASL, and GDPR) and honor unsubscribe requests.
• Hosts may not sell or misuse participant information collected through ChirpnBirdies.

7. Communications & Email

ChirpnBirdies provides integrated email services that allow Event Hosts to communicate with participants. We deliver both transactional messages (such as event updates) and optional promotional messages. Promotional emails will always include an unsubscribe option. ChirpnBirdies facilitates email delivery but does not endorse or control message content sent by Hosts.

8. Prohibited Conduct

You agree not to:

• Provide false information or impersonate another person.
• Use the Service for fraudulent, unlawful, or abusive purposes.
• Interfere with or disrupt the operation of the Service.
• Access data not intended for you or attempt to breach system security.
• Use participant data for marketing without consent.

9. Ownership & Intellectual Property

All content, features, and software on the Service are the property of ChirpnBirdies, LLC and protected under U.S. and international copyright laws. You may not copy, modify, distribute, or use any part of the Service without prior written permission.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. CHIRPNBIRDIES DOES NOT GUARANTEE THAT EVENTS WILL OCCUR AS SCHEDULED OR THAT EVENT HOSTS WILL PERFORM AS ADVERTISED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHIRPNBIRDIES, LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVENT PARTICIPATION, OR PAYMENT PROCESSING. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE FEES PAID BY YOU TO CHIRPNBIRDIES DURING THE 12 MONTHS PRIOR TO THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless ChirpnBirdies, LLC, its employees, contractors, and affiliates from any claims, damages, or expenses (including legal fees) arising out of your use of the Service, violation of these Terms, or participation in any Event.

13. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for behavior we determine harmful to the platform or community. You may close your account at any time by contacting [email protected].

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Missouri, in the United States of America, without regard to conflict of law principles. Any disputes arising under or related to these Terms shall be resolved in the courts located in St. Louis County, Missouri. You agree to submit to the personal jurisdiction of those courts for resolution of any dispute.

15. Changes to These Terms

We may update or revise these Terms periodically. Material updates will be announced via email or notice on our website before becoming effective. Continued use of the Service after such notice constitutes your acceptance of the revised Terms.
